The Approval of The 2018 Farm Bill

On the day of December 12, 2018, Congress voted to pass the farm bill, also known as the Agriculture Improvement Act of 2018. The House of Representatives approved the bill with a 369 to 47 vote, while the Senate approved the bill with an 87 to 13 vote. The Republican senator from Kentucky, Mitch McConnell, championed the bill as he’s been in support of hemp legalization for a long time due to its importance in the textile industry, cosmetics, and biofuel production. On the day of December 20, just 8 days after being approved, President Trump signed the 2018 Farm Bill into law.

WHAT DOES THE 2018 FARM BILL DO?

The 2018 Farm Bill creates a distinction between Hemp and Marijuana, ultimately removing it from the Controlled Substances Act, and placing it into the hands of the Department of Agriculture. Within the farm bill, under section 12619, any cannabinoid derived from hemp is considered legal. In addition, the 2018 Farm Bill made all derivatives and isomers in hemp legal, as long as the final product contains less than 0.3% Delta-9 THC.

WHAT DOES THIS MEAN FOR DELTA-8 THC?

Although Delta-8 THC is a powerful cannabinoid native to the cannabis plant that is often found in very small amounts (when being compared to Delta-9 THC), delivers psychoactive effects, and only differs from Delta-9 THC by a few atomic bonds, Delta-8 THC is completely legal. The question is, how is it legal when it has psychoactive capabilities similar to Delta-9 THC, the cannabinoid most known for producing the high in marijuana? It is quite interesting how this works. Delta-8 THC is actually an isomer of CBD. It is also both a derivative of hemp and CBD, and it’s also a cannabinoid found in hemp. This part here means that it is legal, as long as the final product contains less than 0.3% Delta-9 THC.
